Our client was arrested for Aggravated Battery with Great Bodily Harm, a second-degree felony with a maximum sentence of 15 years in prison. The case stemmed from an alleged road rage incident, but through investigation, depositions, and discovery, it was revealed that our client was also a victim. The other driver, while driving under the influence, had side-swiped our client’s vehicle and attempted to run him over, leading to the altercation in which our client was accused of beating the other driver with a guard rail.
Given the complex circumstances and our client’s need for substance abuse and mental health treatment, we secured acceptance for him at a treatment facility. After extensive depositions and negotiations, we successfully arranged a downward departure, sparing our client from prison.
He was ultimately sentenced to one year in jail, which was considered time served, allowing him to begin his treatment program in a residential facility.
